PDP Performance — operated by Premier Diamond Performance LLC

These Terms of Service ("Terms") govern your use of the PDP Performance application ("the App"), operated by Premier Diamond Performance LLC ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.
The App is intended for use by athletes who are current members of the Premier Diamond Performance LLC training roster and by authorized coaching staff. Athletes under the age of 18 may use the App only with the consent of a parent or guardian, communicated to our coaching staff. By using the App, you represent that you are either at least 18 years of age or have parental/guardian consent.
Access to the App is granted by authorized coaching staff who add athletes to the roster with their phone number. Authentication is performed via SMS one-time codes sent to the registered phone number. You are responsible for safeguarding your phone and the codes you receive. If you believe your account has been accessed without authorization, contact our coaching staff immediately.

The App displays training programs, drill recommendations, and performance assessments developed by our coaching staff and, in some cases, generated with the assistance of artificial intelligence tools. Training content is provided for informational and instructional purposes and should always be performed under the guidance of qualified coaching staff. You are responsible for assessing whether any training activity is safe and appropriate for your individual physical condition.
Baseball and softball training involves inherent physical risks, including the risk of injury. The App does not provide medical advice. You should consult a qualified medical professional before beginning, modifying, or continuing any training program, especially if you have existing health conditions, recent injuries, or concerns about your physical readiness. Premier Diamond Performance LLC, its coaching staff, and the App are not responsible for injuries or health outcomes resulting from training activities. If you experience pain, discomfort, or unusual symptoms during training, stop immediately and consult a medical professional.
The App may prompt you to self-report wellness information including sleep quality, soreness, and arm condition before sessions. This information is used to adjust training recommendations. Honest self-reporting helps coaching staff make safe decisions about your training. The wellness adjustment system is a tool to assist coaching judgment, not a substitute for it.
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
By using the App, you consent to receive SMS one-time authentication codes at the phone number associated with your roster entry. Message and data rates may apply per your mobile carrier. You may opt out at any time by replying STOP to any message; doing so will prevent SMS-based login until you opt back in by contacting our coaching staff.
We make reasonable efforts to keep the App available and functioning, but we do not guarantee uninterrupted access. The App may be unavailable for maintenance, updates, or due to circumstances outside our control. We may modify, suspend, or discontinue any part of the App at any time without notice.
The App, including its software, design, training program structures, drill libraries, and content, is the property of Premier Diamond Performance LLC or its licensors and is protected by intellectual property laws. You may use the App for personal, non-commercial purposes consistent with your role as a member of the training roster or coaching staff.
We may suspend or terminate your access to the App at any time if you violate these Terms or if you are no longer an active member of the training roster. Upon termination, your right to use the App ceases, but provisions of these Terms that by their nature should survive termination (including disclaimers, indemnities, and limitations of liability) will remain in effect.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT TRAINING RECOMMENDATIONS WILL PRODUCE SPECIFIC RESULTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, PREMIER DIAMOND PERFORMANCE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO INJURY DURING TRAINING, LOST DATA, OR INTERRUPTION OF SERVICE. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the App shall be resolved in the state or federal courts located in Maricopa County, Arizona.
We may update these Terms from time to time. The current version will always be available at this URL, and the effective date at the top of the page will reflect the most recent update. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
